First Hour (The Duty of Confidentiality) - A discussion of the Duty of Confidentiality in MRPC 1.6 as
effectuated through the attorney client privilege and the work product doctrine with a focus on how to
best guide the client to preserve the privilege. The program will also include an examination of the
confidentiality obligation in several specific recurring circumstances such as whether a data breach
report can remain privileged, what documents can be shared with an auditor without losing the
privilege, and the latest cases on the “functional equivalent” employee doctrine.

Second Hour (A Brave New World) – The ethical landscape for lawyers is undergoing significant change.
The influence of technology through Generative AI and the options of remote work create new ethical
issues for the legal profession. This hour will address those issues as well as the most recent ethical
decisions concerning wire transfer scams and the inadvertent production of documents.
